These general and specific conditions apply to sales contracts for products and services provided by the Royal Ours Blanc hotel.

These general and special conditions of sale take precedence over any other previous conditions or any general conditions of purchase.

The pre-contractual information is presented in French and in English; they will be the subject of a confirmation including this information at the time of the purchasing procedure. Royal Ours Blanc 2 reserves the right to cancel any order from a customer with whom there is a payment dispute without the latter being able to claim any compensation for any reason whatsoever.

In the event of an online reservation, the data recorded by Royal Ours Blanc 2 on the website hotelroyaloursblanc.com constitutes proof of all transactions between the Royal Ours Blanc hotel and its customers.

The data recorded by the payment system constitutes proof of financial transactions. Acceptance of cookies is essential for any purchase on lemontanahotel.com. In the event of a reservation with the reception team, receipt of part (or all) of the amount of the stay as stipulated in section III Payment below, constitutes proof of all transactions between the Royal Ours Blanc hotel and its customers.

I.Object

Each test contract concluded for tourist accommodation. Guests of the Royal Ours Blanc hotel must not engage in any commercial, artisanal or professional activity there. The Law of July 6, 1989 relating to residential leases cannot be applied to sales contracts concluded between the Royal Ours Blanc and its customers, particularly with regard to maintaining the premises. Consequently, the contract will be governed by the provisions of the Civil Code, the Tourism Code, the Consumer Code as well as by the conditions provided for herein. For clarification, the consumer's right of withdrawal, provided for in the Consumer Code, is not applicable for “accommodation, transport, catering and leisure services which must be provided on a date or according to a determined periodicity. Therefore, the right of withdrawal is not applicable to all contracts concluded with the Royal Ours Blanc hotel.

 

II.Price

Royal Ours Blanc 2 reserves the right to modify its prices at any time. Stays are all billed based on the rates in effect at the time the reservation is made. All orders, whatever their origin, are payable in Euros. Prices are per accommodation per night, unless otherwise indicated. They do not include tourist tax, additional services or sports packages. Our product offers and prices are valid as long as they are visible on the site mentioned above in the case of an Internet reservation, or when requesting information by telephone in the case of a reservation from the reception team.

 

III.Payment

When booking online through hotelroyaloursblanc.com, the customer must pay, depending on the cancellation conditions of the chosen offer, a minimum of 50% of the amount of the stay at the time of booking. The customer can choose to pay this amount by credit card or bank transfer. The remaining 50% must be paid upon arrival of the client at the Royal Ours Blanc hotel to the reception team. The payment methods accepted are as follows:

Any reservation made less than 24 hours from the day of arrival, the entire amount of the stay must be paid at the time of booking, either by credit card on hotelroyaloursblanc.com or by another payment method indicated above with the reception team directly.

Online payment is secure. Payment for purchases is made by credit card: CB, Visa, Mastercard and American Express cards are accepted. The customer must have paid the entire balance of their stay by the due date.

In the event of a balance not paid within the deadline, Royal Ours Blanc 2 reserves the right to consider the reservation as void and to apply the cancellation conditions provided for this purpose and defined below accordingly.

 

IV. Tourist tax

Tourist taxes are not included in the rates. Their amounts, calculated per person and per night, are set by the Alpe d’Huez Town Hall. They tasked Royal Ours Blanc 2 with collecting them from customers and paying them back.


V. Cancellation conditions

In the event of cancellation of the stay by the customer, the following fees will be retained for flexible rate reservations: 50% of the total amount of the stay
The following fees will be retained for non-refundable rate reservations: 100% of the total amount of the stay

Any cancellation must be notified in writing to the Royal Ours Blanc hotel. The effective date of a written cancellation will be the date of receipt thereof.

 

VI. Abandonment of stay

The client will not be able to claim any compensation or reimbursement if he shortens or interrupts his stay for any reason whatsoever (including strike, medical repatriation, etc.). Any unused service will not be refunded.


VII. Modifications of essential elements by the seller

In the event of force majeure or any unforeseen circumstances, Royal Ours Blanc 2 reserves the right to partially or totally modify its services, both concerning accommodation and optional services. Those which are not provided will not be billed. In this case, after having been previously informed of this or these modifications either by e-mail or telephone call, the customer can either:

- Terminate your contract and obtain immediate reimbursement of the sums paid without penalty;

- Accept the modification(s) or the replacement trip proposed by Royal Ours Blanc 2. From then on, an amendment to the contract specifying the modifications made is then signed by the parties; all price reductions are deducted from any sums remaining due by the customer and, if the payment already made by the latter exceeds the price of the modified service, the surplus must be returned to him before the date of his departure.

 

VIII. Modifications of essential elements by the customer

If the customer wishes to modify their reservation, once it has been confirmed and 24 hours before the day of arrival, Royal Ours Blanc 2 will do everything possible to satisfy them. Subject to availability and at the discretion of Royal Ours Blanc 2, the duration of the stay may be extended at the customer's request, without obligation for Royal Ours Blanc 2 to keep them in the same room or to charge the initial agreed price. If an extension of the stay is accepted followed by a new price, this will be applicable from the initial arrival date. He must then notify this modification by letter, accompanied by a check for €35 for administrative charges, no later than 31 days before the arrival date. Otherwise, this change will be considered a cancellation of the original reservation and will be subject to the cancellation conditions set out above.


IX. Arrival and departure times

The rooms at the Royal Ours Blanc hotel are available to the client from 4 p.m. on the day of arrival. On the day of departure, they must be released by 11 a.m. at the latest – for any later departure, an additional day will be charged.

 

X. Accomodation

All accommodation (rooms) presented to customers comply with French safety standards and are regularly checked. They are equipped for tourist stays. In the description, the maximum number of beds in each rental is systematically specified. Under no circumstances can the accommodation be occupied by a number greater than that indicated in the contract. The client may find it a little cramped if he chooses to accommodate a maximum number of people. Facilities such as the collective swimming pool, the sauna, the hammam, the whirlpool pool, the games, or where certain additional activities are offered in collaboration with other service providers, customers must first ensure that they be in good physical condition, in good health and able to use them or participate in them. They must also ensure that they have read the use, maintenance and safety instructions, understood them and complied with them. If these instructions have not been respected or more generally in the event of fault of the users, the Royal Ours Blanc hotel declines all responsibility in the event of damage, loss or injury to said users. The Royal Ours Blanc hotel reserves the right to prohibit access to these facilities or services to any person refusing to comply with the operating and safety rules.

XI. Responsibility

Royal Ours Blanc 2 cannot be held liable in the event of theft or damage to personal effects present in the accommodation, including in individual safes, common premises, parking and any other outbuildings or annexes to the accommodation. . The provisions of the Civil Code (art. 1952 et seq.) relating to the civil liability of hoteliers will not be applied herein. Likewise, no liability can be held against the Royal Ours Blanc hotel in the practice of sporting or other activities, organized locally or not, in the event of injury, illness or death suffered by a client. . Royal Ours Blanc 2 cannot be held responsible for fortuitous cases of force majeure or nuisance disrupting, interrupting or even preventing the stay. XII. Penalty for late payment

For each unpaid due date, management fees amounting to 15 euros per reminder, from the second reminder letter, will be payable by the customer. In the event that the case becomes contentious, the debt will be increased by management fees and interest at the legal rate in force, as well as any processing and recovery costs of all kinds. Recovery costs of €40 will be due by the professional contracted with Royal Ours Blanc 2 in the event of late payment. This amount will be increased by interest at the legal rate in force, current upon late payment.


XIII. Claim

Any possible complaint during the customer's stay must be reported immediately to the Manager, in order to resolve the problem as quickly as possible. If it cannot be resolved on site, the customer must send a letter within 28 days of arrival, detailing their complaint. After this period, no claim will be taken into account and will be automatically foreclosed. In all cases, under penalty of automatically inadmissible the complaint, the customer must systematically pay the entire stay without being able to exercise any deduction of his own initiative or expressly agreed to by Royal Ours Blanc 2.

 

XIV. Disputes, amicable or judicial resolution

Before initiating any legal procedure, the parties undertake to attempt to resolve their
amicable dispute. To do this, any complaint must first be sent by registered letter within 30 days following the stay to the following address:

In the event of failure to resolve their dispute amicably, the parties will take responsibility for referring the matter to the competent court.
