PREAMBLE

These General Terms and Conditions of Sale (hereinafter referred to as the “Terms and Conditions”) govern the contractual relationship between Royal Ours Blanc Hotel (hereinafter referred to as the “Hotel”) and any individual or legal entity making a reservation for accommodation or ancillary services (hereinafter referred to as the “Guest”), either directly with the Hotel or through its official website.

These Terms and Conditions apply to all reservations made:

  • via the Hotel’s official website;
  • by telephone;
  • by email;
  • directly at the Hotel reception.

By confirming a reservation, the Guest acknowledges having read and accepted these Terms and Conditions without reservation.

These Terms and Conditions shall prevail over any other terms or conditions unless expressly agreed otherwise in writing by the Hotel.

Pre-contractual information is provided to the Guest in accordance with the applicable provisions of the French Consumer Code.

ARTICLE 2 - PURPOSE

These Terms and Conditions define the booking, payment, cancellation and stay conditions applicable to accommodation services provided by the Hotel, together with any additional services purchased either during the booking process or throughout the Guest’s stay.

The services offered are intended exclusively for tourist accommodation purposes.

Guests may not carry out any commercial, industrial, professional or business activity within the Hotel without the Hotel’s prior written consent.

The contractual relationship between the Hotel and the Guest shall be governed in particular by:

  • the French Civil Code;
  • the French Consumer Code;
  • all applicable laws and regulations governing the hotel industry.

ARTICLE 3 - NO RIGHT OF WITHDRAWAL

In accordance with Article L221-28 (12) of the French Consumer Code, accommodation services supplied on a specific date or during a specified period are exempt from the statutory right of withdrawal provided under Articles L221-18 and following of the French Consumer Code.

Accordingly, all reservations become final under the terms of the selected rate once confirmed.

ARTICLE 4 - BOOKINGS

A reservation shall become final only after:

  • acceptance by the Hotel;
  • payment or provision of a valid payment guarantee, depending on the selected rate;
  • confirmation of the reservation being sent to the Guest.

The Hotel reserves the right to refuse or cancel any reservation in the event of:

  • manifestly incorrect or incomplete information;
  • fraud or attempted fraud;
  • a previous unpaid balance;
  • technical impossibility beyond the Hotel’s control.

Reservations are personal and may not be transferred to another person without the Hotel’s prior written consent.

Any special request (baby cot, connecting rooms, floor preference, specific view, dietary requirements, etc.) will be accommodated whenever reasonably possible but does not constitute a contractual obligation.

ARTICLE 5 - RATES

All prices are expressed in Euros (€), inclusive of VAT where applicable, but exclusive of tourist tax unless otherwise stated.

Rates include only those services expressly specified at the time of booking.

Unless otherwise indicated, rates do not include:

  • tourist tax;
  • optional services;
  • bar consumption;
  • spa treatments;
  • any other service not expressly included in the booked rate.

The applicable rates are those in force on the date the reservation is confirmed.

The Hotel reserves the right to modify its rates at any time. However, no price modification shall apply to reservations that have already been confirmed.

Promotional offers remain valid only for the period during which they are advertised and subject to availability.

ARTICLE 6 - PAYMENT

6.1 Accepted Methods of Payment

The Hotel accepts payment exclusively by:

  • CB (French bank cards)
  • Visa
  • Mastercard
  • American Express
  • Bank transfer
  • Cash, within the limits permitted by French law.

Payments by cheque are not accepted.

6.2 Reservations Made via the Hotel Website

Flexible Rate

A valid credit or debit card is required at the time of booking as a guarantee.

Unless otherwise specified, the total amount of the stay will automatically be charged two (2) days prior to the scheduled arrival date.

Non-Refundable Prepaid Rate

The total amount of the stay is charged immediately upon confirmation of the reservation.

6.3 Reservations Made by Telephone or Email

For reservations made directly with the reception team, the Guest will receive a secure payment link allowing payment of the reservation.

The amount requested depends on the selected rate:

Flexible Rate

Payment of 100% of the total stay is required at the time of booking.

This amount will be fully refunded if the reservation is cancelled in accordance with the Flexible Rate cancellation policy, namely up to two (2) days before the scheduled arrival date.

In the event of cancellation less than two (2) days before arrival, failure to arrive (no-show) or early departure, the amount paid shall be retained by the Hotel.

Non-Refundable Prepaid Rate

Payment of 100% of the total stay is required at the time of booking.

This payment is final and non-refundable, except where otherwise required by mandatory law.

6.4 Card Pre-authorisation

Upon arrival, the Hotel may request a credit or debit card pre-authorisation of €50 per night of stay.

The pre-authorisation is intended to secure payment of:

  • any outstanding charges;
  • damage caused by the Guest;
  • any other sums owed to the Hotel.

A pre-authorisation is not a charge.

Only amounts actually due and duly justified may subsequently be charged in accordance with the applicable legal provisions.

6.5 Non-Payment

Failure to pay any amount due may result in:

  • cancellation of the reservation;
  • refusal of admission to the Hotel;
  • refusal to continue the stay, without prejudice to any outstanding amounts remaining payable.

Where late payment is attributable to a business customer, the penalties provided for under the French Commercial Code shall apply.

ARTICLE 7 - TOURIST TAX

The tourist tax is not included in the published room rates.

Its amount is determined by the Municipality of Alpe d’Huez in accordance with the applicable regulations and is calculated according to the criteria established by the local authorities.

The tourist tax is payable by all guests who are legally liable and shall be charged in addition to the accommodation rate.

Any change in the amount of the tourist tax decided by the competent authorities shall automatically apply to the relevant reservations.

ARTICLE 8 - CANCELLATION POLICY

Cancellation conditions depend on the rate selected at the time of booking.

8.1 Flexible Rate

The Guest may cancel the reservation free of charge up to two (2) days prior to the scheduled arrival date, before midnight (hotel local time).

If the cancellation is made within this period:

  • no cancellation fee shall apply;
  • any amount already paid shall be refunded in full using the original method of payment.

In the event of cancellation less than two (2) days before arrival, failure to arrive (no-show) or early departure, 100% of the total booked stay shall remain payable.

8.2 Non-Refundable Prepaid Rate

The total amount of the stay is charged at the time of booking.

This rate cannot be modified, cancelled or refunded for any reason whatsoever, except where otherwise required by mandatory applicable law.

8.3 Cancellation Procedure

Any cancellation request must be submitted in writing, either by email or through the booking channel used, where such functionality is available.

The effective date of cancellation shall be the date on which the Hotel receives the cancellation request.

ARTICLE 9 - MODIFICATION OF A RESERVATION

Any request to modify a reservation (including stay dates, number of occupants, room category or any additional service) is subject to:

  • the Hotel’s availability;
  • the rates and conditions applicable on the date of the modification request.

The Hotel will make every reasonable effort to accommodate modification requests but cannot guarantee that such requests will be accepted.

Depending on the nature of the requested modification, a rate adjustment may apply.

If a requested modification cannot be accommodated, the Guest may cancel the reservation in accordance with the cancellation policy applicable to the selected rate.

ARTICLE 10 - CHECK-IN AND CHECK-OUT

Rooms are available from 4:00 p.m. on the day of arrival.

Rooms must be vacated no later than 11:00 a.m. on the day of departure.

Late arrivals are accepted provided the Hotel has been informed in advance.

Any occupation of the room beyond the official check-out time, without the Hotel’s prior agreement, may result in the charge of an additional night’s accommodation at the applicable rate.

ARTICLE 11 - ROOM OCCUPANCY

The maximum occupancy permitted for each room category is specified at the time of booking.

For safety and insurance reasons, this maximum occupancy may not be exceeded.

The Hotel reserves the right to refuse admission to any undeclared additional guest or, where possible, to require the reservation of a more suitable room.

Children are included in the room occupancy unless otherwise expressly stated during the booking process.

ARTICLE 12 - PETS

Pets are welcome at the Hotel, subject to the Hotel’s prior approval.

A supplement of €15 per pet, per night applies.

This supplement may either be added during the online booking process or charged directly by reception.

Pets must be kept on a leash in all public areas of the Hotel and must not be left unattended in guest rooms where they may cause disturbance or damage.

The owner remains solely responsible for any damage, nuisance or injury caused by their pet.

The Hotel reserves the right to refuse admission to, or require the removal of, any animal considered dangerous or causing disturbance to other guests or members of staff.

ARTICLE 13 - SPA, SWIMMING POOL AND WELLNESS FACILITIES

The Hotel provides guests with access to a wellness area including, among other facilities, a spa, a swimming pool and relaxation facilities.

Access conditions, opening hours, applicable prices and internal regulations are available at reception and on the Hotel’s official website.

Access to the spa is subject to prior reservation and may be limited according to availability.

Spa treatments are subject to specific booking and cancellation conditions.

Guests agree to comply with all safety, hygiene and operating rules displayed within the wellness facilities.

The Hotel reserves the right to refuse access to any guest who fails to comply with these rules or whose behaviour may compromise the safety, comfort or well-being of other guests.

ARTICLE 14 - HOTEL LIABILITY

The Hotel shall use all reasonable means to ensure that the Guest’s stay is provided in accordance with the confirmed reservation.

The Hotel’s liability shall be assessed in accordance with the applicable provisions of French law, including those governing the liability of hotel operators under the French Civil Code.

The Hotel shall not be held liable for any damage resulting from:

  • an event of Force Majeure as defined by Article 1218 of the French Civil Code;
  • the unforeseeable and unavoidable act of a third party unrelated to the services provided;
  • any fault, negligence or misconduct attributable to the Guest.

The Guest shall remain liable for any damage caused by themselves, their accompanying persons or any pet under their responsibility.

The Hotel reserves the right to charge the Guest for any costs incurred in repairing, replacing or restoring property damaged during the Guest’s stay.

ARTICLE 15 - PERSONAL BELONGINGS AND LOST PROPERTY

Guests are responsible for the supervision and safekeeping of their personal belongings throughout their stay.

Where possible, personal belongings left behind at the Hotel shall be retained for a period of six (6) months from the date they are found.

Upon request, lost property may be returned to the Guest at the address provided, provided that the Guest bears the cost of packaging and shipping.

After the six (6) month retention period, and in the absence of any claim by the Guest, the Hotel may dispose of, recycle or donate the unclaimed property to a charitable organisation, depending on its nature.

ARTICLE 16 - NON-SMOKING POLICY

All guest rooms and indoor areas of the Hotel are strictly non-smoking.

This prohibition also applies to electronic cigarettes and any similar devices where required by applicable legislation or the Hotel’s internal regulations.

In the event of non-compliance with this policy, the Hotel reserves the right to charge the Guest for any actual costs incurred in cleaning, deodorising, restoring or temporarily taking the room out of service where such costs are directly attributable to the breach of this policy.

ARTICLE 17 - FORCE MAJEURE

Neither party shall be held liable for any failure or delay in performing its contractual obligations where such failure or delay results from an event of Force Majeure, as defined by Article 1218 of the French Civil Code.

Where an event of Force Majeure prevents the Hotel from performing all or part of its obligations, the Hotel shall inform the Guest as soon as reasonably practicable and shall take all reasonable measures to minimise the consequences of such event.

Where a Guest invokes an event of Force Majeure, the Guest shall remain bound by the rate conditions and contractual terms applicable to the reservation, unless otherwise required by mandatory law or expressly agreed by the Hotel.

ARTICLE 18 - PERSONAL DATA

Personal data collected in connection with reservations and stays are processed solely for the purposes of managing reservations, guest stays, invoicing, customer relations and compliance with the Hotel’s legal and regulatory obligations.

Such processing is carried out in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and the applicable French data protection legislation.

Guests have the right to access, rectify, erase, restrict the processing of, object to the processing of and request the portability of their personal data, subject to the conditions laid down by applicable law.

These rights may be exercised at any time by contacting the Hotel by post or by email using the contact details provided in these Terms and Conditions.

For further information regarding the processing of personal data, Guests are invited to consult the Hotel’s Privacy Policy available on its official website.

ARTICLE 19 - COMPLAINTS

The Hotel places great importance on guest satisfaction.

Should any issue arise during the stay, the Guest is encouraged to notify reception or Hotel management as soon as possible so that an appropriate solution may be sought without delay.

If the matter cannot be resolved during the stay, the Guest may submit a written complaint to the Hotel using the following contact details:

All complaints shall be carefully reviewed and answered as promptly as possible.

Nothing in this Article shall affect the statutory rights granted to consumers under applicable law.

ARTICLE 20 - CONSUMER MEDIATION

In accordance with Articles L.612-1 and following of the French Consumer Code, consumer Guests have the right to refer any unresolved dispute with the Hotel to a consumer mediator free of charge.

Before referring the matter to the mediator, the Guest must first submit a written complaint to the Hotel in accordance with Article 19 of these Terms and Conditions.

If no satisfactory response is received, or if no response is provided within sixty (60) days of receipt of the complaint, the Guest may refer the matter to:

Mediation is an alternative method of dispute resolution. The Guest remains free to accept or decline mediation and retains the right to bring the dispute before the competent courts.

ARTICLE 21 - APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions shall be governed by and construed in accordance with French law.

In the event of a dispute, the parties shall endeavour to resolve the matter amicably before initiating legal proceedings.

Failing an amicable settlement, the dispute shall fall within the jurisdiction of the competent French courts in accordance with the applicable legal rules.

ARTICLE 22 - ACCEPTANCE OF THE TERMS AND CONDITIONS

Any reservation made with the Hotel constitutes full and unconditional acceptance of these General Terms and Conditions.

The Guest acknowledges having read these Terms and Conditions prior to confirming the reservation and agrees to be bound by them without reservation.
